The tax court must set a time limit (at least 45 days) for the appeal of the taxpayer's judgment. The taxpayer then has a right to file the petition on the IRS's own behalf if the appeal is timely filed. 3. (5) If appeal is timely filed, the court reviews the appeal (Form 8858). The court will then rule on the taxpayer's petition. The Tax Court must make a decision within 45 days from the date of the filing of Form 8858.
