Has not made a sufficient and diligent effort to establish competence with respect to his or her mental illness or mental defect before appointment by the Probate Court of Oakland County. “The Probate Court of Oakland County, in the County of Livingston, has determined that the following individuals may be appointed as guardians of the decedent's interest: 1. The guardian is in good standing, 2. The guardian is of good moral character, and 3. The guardian has adequate knowledge of the decedent's interests in the disposition of his or her estate, with respect to any living adult or children under the decedent's care. In this case, the Probate Court has determined that the guardianship of the decedent shall be held in place by the guardian's appointment. (This opinion is issued and is effective as of April 13, 2012.) “The court has issued this opinion for the sole purpose of assisting the Probate Court to manage the custody and disposition of the estate of the decedent. For that purpose, it is the opinion of the court that it is appropriate for the Probate Court of Oakland County to assume the guardianship of the estate of the decedent.
